GENERAL TERMS AND CONDITIONS OF MAGICAL CHILDHOOD PHOTOGRAPHY AWARDS International Competition (the „MCPA”)

  1. MCPA is an international online photography competition held every seasonal round: Spring, Summer, Autumn, Winter commersing from May 2023.
  2. MCPA is organized by:

I. TERMS OF ENTRY

  1. The competition under MCPA is announced in eight categories (the Categories):
    • Pregnancy
    • Newborn 0-6 months
    • Toddlers 6 months – 3 years old
    • Children 4-12 years old
    • Youth 13-21 years old
    • Family
    • Studio
    • Fine Art ( all photo manipulations included).
  2. A candidate can participate in the MCPA by
    (i) designating the category in which the submitted picture is applied,
    (ii) transfer of the entry fee to the payment of the entry fee via payment options on MCPA website,
    (iii) sending pictures as a digital image to the competition of MCPA via email.
  3. Entry fee shall amount to EUR 10 per picture and package discount possibly.
  4. All prices on the Website are given in EUR. Prices shown to the Customer include value added tax (VAT) at the applicable rate. If a Customer is not obliged to pay VAT (for example his residence is outside of the EU), he shall contact the Seller before placing the Order in order to apply the correct VAT amount or to check the Seller’s eligibility to sell to the Customer’s country.
  5. Submissions of pictures to the competition of the following round shall be made by : 1.01-29.03; 1.04-29.06; 1.07-29.09; 1.10-29.12 of each year.
  6. Entry for MCPA competition is considered valid if all preconditions listed in subsection 2 above are fully met prior to the closing time for entries.
  7. Participants can not resign from paid submission, as first selection of the competition will be made when “Organizator” will receive the photos. Those who didn’t get to the second stage- JURY VOTING will get short feedback. Photos who will go to the second stage will be published on Instagram: @magical_childhood_photography and this way will get promotion of “Participant” work.
  8. Photos will take part in a voting of a JURY- which will be the second stage of the competition. The decision of the Jury is final.

 

II. ANNOUNCEMENTS

  1. Each round, first places, second places, and third places from all categories  and 5-10  noteworthy prizes will be awarded from the photos entered into the competition. Unless there were less than 10 photos submitted to the category during the month. In this case category will be combined with other ones.
  2. Until the end of January each year, the photographer who has achieved the best result during the year will be announced and will receive the MCPA “Photographer of the year” Title.
  3. 1, 2, 3 Awards in each category badges are the awards  at the end of each round among the pictures entered during the given Entry Period and the results will be announced the 5th day of next month.
  4. All the winners’ photos will be published in Magical Childhood Photography Awards online Magazine if winners will send them in a required size to the Magazine by email.
  5. The winners will be responsible for the possible costs associated with the acceptance of the prize.

 

III. TERMS OF PARTICIPATION

  1. Participation in and entry for MCPA can only take place online.
  2. Candidates must be at least 18 years of age as of the date of entry.
  3. Those, who are in any way related, directly or indirectly,  to the Organizer of MCPA, its employees, affiliates, employees of the affiliates, are excluded from the competition.
  4. Pictures entered for MCPA may not be regarded as obscene, offensive, provocative, defamatory, violent, pornographic, harassing, racist or otherwise inappropriate. Pictures taken as inappropriate are disqualified and the Organizer reserves the right (i) to delete any uploaded pictures considered inappropriate and (ii) exclude the respective candidate from the competition.
  5. The Owner holds and reserves all intellectual property rights for any such content.
  6. Photos submitted to the contest must belong to the Participant. He/she must be the only author of the photo.
  7. Photos which were created at any classes or workshops can not participate in the competition. As all processes to create it were prepared by the other photographer.

 

IV. REPRESENTATIONS AND UNDERTAKINGS OF CANDIDATES

By submission of any pictures to the website of MCPA, the candidate:

  • declares that he has all rights to the submitted picture and the picture is free of any third party rights,
  • confirms that no copy rights attached to the submitted picture are infringed,
  • verifies that any person appearing on the submitted picture has consented to the taking of, and publication of, the picture,
  • accepts and acknowledges the terms of data protection of the Organizer published on the website of MCPA,
  • consents to the use by the Organizer of personal data disclosed concurrently with the submission of pictures,
  • undertakes to release the Organizer from any and all claims asserted by any third party, for infringement of their rights or in connection with the breach by the candidate of any of the undertakings herein, and
  • undertakes to indemnify the Organizer for any penalty or fine imposed against the Organizer by the authorities, including but not limited to, data protection authority or copyright law enforcement agency, in connection with the breach by the candidate of any of the above representations and undertakings.

 

V. CONDITIONS TO PARTICIPATE

PICTURES
The participant assures that he has all rights to the submitted picture, has the full rights of exploitation of all parts of the picture, that the picture is free of third party rights, and that no personality rights are infringed in the representation of persons. If one or more persons are shown on the picture, the persons concerned must agree to the publication of the picture. The participant will insure the above in writing. If, however, third parties are entitled to assert claims for infringement of their rights, the participant shall release the organisers from all claims. Photographs taken at the computer may not contain pictures from magazines, books, CDs purchased, etc.

Entries shall be assessed in accordance with the assessment criteria as defined below. Your photos may not contain any obscene, provocative, defamatory, sexually explicit or otherwise offensive or inappropriate content. Photos taken as inappropriate are disqualified.

CONTENT
The images submitted as part of the MCPA may not be regarded as obscene, offensive, defamatory, ethically offensive, violent, pornographic, harassing, inappropriate for minors, racist, racist, xenophobic, right-wing and / or otherwise objectionable. The upload of the corresponding pictures can lead to the exclusion from the photo competition according to the conditions of participation. The organizer reserves the right to delete uploaded pictures before or after publication, without giving reasons.

EXCLUSION FROM MCPA
In case of a breach of these terms, MCPA reserves the right to exclude persons from the MCPA It also excludes persons who use unauthorised tools or who otherwise benefit from manipulation. In such cases, profits can also be recognised and reclaimed subsequently. It is also excluded, who makes untrue personal details.

AWARDS AND CERTIFICATES FOR THE PARTICIPANTS
Awards and prizes are published on the MCPA homepage.

PREMATURE TERMINATION OF THE PHOTO COMPETITION
The organisers of the MCPA reserve the right to cancel or terminate the photo competition at any time without prior notice and without giving reasons. The organizer shall make use of this possibility in particular if, for technical reasons (e.g. viruses in the computer system, manipulation or errors in the hardware and / or software) or for legal reasons, proper performance of the photocopy can not be guaranteed.

LIABILITY
The organizer accepts no liability for the loss or possible damage to the submitted pictures.

DATA PROTECTION
In order to participate in the MCPA it is essential to accept the current data protection. The participant is at any time free to revoke the consent to the storage by revocation at moose.photohoots@gmail.com and thus withdraw from the participation. The data submitted by the senders will be passed on to third parties involved in the publication of the images within the scope of the MCPA (reporting on this, prize lending, etc.), such as journals or exhibition organisers. The participant expressly agrees hereby.
